1. Acceptance of Terms
These Terms and Conditions (“Terms”) govern your access to and use of Localgofer’s network of local directory websites and services (“Localgofer” or the “Service”). By registering an account, listing a business, or otherwise using the Service, you agree to these Terms. If you do not agree, you must not use Localgofer. Users will be required to accept these Terms during sign-up, and this forms a binding agreement between you (the “User”) and Localgofer.
2. Description of Service
Localgofer operates a network of online local business directories in New Zealand. The Service enables business owners, marketing / SEO professionals, and others to create and manage business listings across multiple local directory sites, ensuring a consistent business profile on all platforms. We offer several paid subscription plans for listings, each with different features.
All plans allow you to create a business profile with details like business name, description, and contact information. Users can choose whether to display certain contact details (phone number, email address, physical address) on their public listing, and can opt to enable a contact form that allows site visitors to send inquiries. The Service’s goal is to increase your business’s online presence through directory listings; however, Localgofer does not guarantee any specific results (such as improved search engine rankings or customer inquiries) from using the Service.
3. Account Registration and Eligibility
To list a business or use certain features, you must create a Localgofer account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and all activities that occur under your account. If you suspect any unauthorised use of your account, you must notify Localgofer immediately.
By creating an account, you represent that you are at least 18 years old and capable of entering into a legally binding contract. If you are creating a listing on behalf of a company or another person (for example, you are an SEO or marketing professional listing a client’s business), you represent that you have the authority to do so and to bind that business or client to these Terms. Each business should generally have only one listing in our network; before creating a new listing, please check whether the business is already listed to avoid duplicates.
4. User Responsibilities and Acceptable Use
When using Localgofer, you agree to use the Service lawfully and responsibly. You are solely responsible for all content and information you submit to the Service and for ensuring that your business listing remains accurate and up-to-date. In particular, you agree to the following user obligations:
- Provide Accurate Information: You will provide truthful, accurate, and non-misleading information about your business. You will update your listing if any information changes. Do not impersonate any other person or company or misrepresent your affiliation with a business.
- Authority to List: You will only create or claim a listing for a business that you own or are authorised to represent. If you are an agent (e.g., a marketer or SEO professional), you must have the business owner’s consent to create or manage the listing on their behalf.
- One Listing Per Business: You will not create multiple listings for the same business location. Duplicate listings are not allowed, as they can confuse users and undermine the integrity of the directories. If a listing for the business already exists in Localgofer’s network, you should claim or update that listing rather than create a new one.
- No Prohibited Content: You will not submit or include any content in your listing that is illegal, offensive, or otherwise violates these Terms. Prohibited content includes (but is not limited to) content that is defamatory, obscene, harassing, or hateful. Hate speech, racist or discriminatory content, or any content inciting violence or crime is strictly forbidden. You also may not list businesses or services that involve illegal activities or that are not permitted by law. Even though Localgofer allows legal adult-oriented businesses to be listed (e.g. legal adult entertainment or products are permitted), any content of an adult nature must be lawful, not overly explicit in a way that violates decency laws, and must not involve or target minors.
- Regulated and Restricted Businesses: You agree not to use Localgofer to promote certain regulated industries if we have prohibited them. In particular, gambling services are not allowed on our directories, and we reserve the right to refuse listings for other highly regulated or sensitive businesses (for example, illicit drug paraphernalia, unlicensed financial services, etc.) at our discretion. If you are unsure whether your business type is allowed, please contact us in advance.
- No Spam or Malicious Activity: You will not use the Service to engage in spamming, unsolicited advertising, or bulk messaging to users or other listing owners. You will not send unsolicited commercial electronic messages to people through contact information obtained from our directories in violation of the Unsolicited Electronic Messages Act 2007. Similarly, you must not upload viruses, malware, or any malicious code, and you must not attempt to data-mine or scrape the directory content without permission.
- Respect for Others and Law: Your use of Localgofer must comply with all applicable laws and regulations. You must not use the Service in a way that infringes any third party’s rights, including intellectual property rights and privacy rights, or that violates any applicable laws. You also agree not to harass, abuse, or harm others through your use of the Service (for example, if you use the contact form to send messages, you will not send threats or abusive messages).
Localgofer reserves the right to review, edit, or remove any content or listing that violates these rules or any applicable law, at our sole discretion. We may also suspend or terminate accounts engaged in prohibited conduct (see Section 9 on Termination). You understand that compliance with these standards is essential to maintaining a trustworthy directory service.
5. User-Submitted Content and Intellectual Property in Listings
5.1 Ownership of Your Content
As a User, you retain ownership of any original text, images, logos, or other content that you submit to Localgofer for inclusion in your business listing. Localgofer does not claim ownership of your user-submitted content. You are free to use your content in any other way outside of our Service.
However, by submitting or posting content on the Localgofer Service, you grant Localgofer a license to use that content for the purposes of operating, promoting, and improving the Service. Specifically, you grant us a non-exclusive, New Zealand wide, royalty-free, sublicensable license to use, reproduce, publish, translate, distribute, and display your listing content (in whole or in part) across our network of directory websites and in related marketing materials or communications. This license exists so that we can display your business information on the directories and let users find your listings; it also allows us to use snippets or screenshots of listings for promotional purposes (for example, showing an example business profile on a “features” page). This license will end when you remove your content from our Service or delete your account, except to the extent we have already used it in ongoing marketing or it persists in backups/archives.
5.2 Warranties and Permissions for Content
You represent and warrant that you have all necessary rights and permissions to submit the content that you post on Localgofer. This means: (a) you either own the content (for example, you wrote the text and took the photos), or you have obtained permission from the rightful owner to use it; and (b) your content does not infringe or violate the intellectual property or other rights of any third party, and does not violate any laws. You also warrant that your content is truthful to the best of your knowledge (particularly your business details) and that adding it to our directories will not result in any breach of confidentiality or privacy rights.
If you include any copyrighted materials (such as images, logos, or text from another source), you must have the legal right to use those materials. You agree to indemnify and hold Localgofer harmless from any claims or damages resulting from content you provide that infringes someone else’s rights or otherwise violates the law. We do not pre-screen all content, but if we become aware of content that may infringe rights or violate the law or these Terms, we may remove or disable access to that content.
5.3 Content Guidelines and Removal
Localgofer is not responsible for the content that users submit in their listings, and we do not endorse or verify the accuracy of such content. While we have rules (as described in Section 4) and may perform moderation, business listings are created by users and we do not guarantee that every listing is free from inappropriate or unlawful material. If you believe a listing is violating our policies or your rights, please notify us.
We reserve the right (but do not assume the obligation) to remove, edit, or reject any content or listing that we find to violate these Terms or for any other reasonable cause. This can include changes to your listing text for clarity or format, removal of profane or disallowed terms, or outright removal of a listing that breaches our content standards or applicable law. We may also restrict certain content (for example, we may blur or hide explicit images, or require age warnings for certain listings) as needed to comply with New Zealand law or community standards.
5.4 Localgofer’s Intellectual Property
All rights, title, and interest in and to the Localgofer websites and services (excluding your content) are and will remain the exclusive property of Localgofer (and/or its licensors). This includes the website design, layout, look and feel, compilation of directory data, underlying software code, databases, and all trademarks, logos, and content provided by Localgofer. The Localgofer name, logo, and all related names and graphics are trademarks or service marks of Localgofer (unless otherwise stated). You may not copy, distribute, modify, or create derivative works from our website or any of our content (other than your own listings) without our prior written permission, except as allowed by law. Scraping or harvesting data from the directories without authorisation is prohibited. You are granted a limited, revocable license to use the Service for its intended purpose of listing and finding businesses, but not for any competitive or unlawful use.
6. Plans, Fees, and Payment Terms
6.1 Paid Plans and Billing
Localgofer offers paid subscription plans (Basic, Enhanced, Premium, as described in Section 2). By selecting a plan, you agree to pay the applicable fees for that plan. Pricing and payment schedule (e.g. monthly or annual billing, as well as any setup fees or taxes like GST) will be as indicated on our website or order form when you purchase the plan. All fees are charged in New Zealand Dollars (NZD) and are exclusive of GST (15% New Zealand Goods and Services Tax) unless stated otherwise. If GST or any other tax is applicable, it will be added as required by law.
Payments are generally made in advance on a subscription basis. For example, if it’s a monthly subscription, you will be billed at the beginning of each monthly term. You authorise Localgofer (or our third-party payment processor) to charge your provided payment method (such as a credit card) for the recurring subscription fee until you cancel. If a payment fails or is not received on time, we may suspend or cancel your listing (though we will attempt to notify you and give an opportunity to fix the payment issue).
6.2 Refund Policy
All fees are generally non-refundable. Localgofer maintains a no-refund policy for subscriptions, meaning that once you have paid for a term (month, year, or other period), you will not ordinarily receive a refund if you decide to cancel or remove your listing during that term. This reflects the fact that our service involves immediate publication and distribution of your business profile across our network.
Exception – Localgofer’s Fault: In the unlikely event that Localgofer fails to provide the service as promised or is at fault for a significant issue with your listing, we may issue a partial or full refund at our discretion. For example, if a technical error on our part caused your listing not to be displayed for a substantial portion of your paid term, or if we terminate your listing without cause before the end of a paid period, we would consider refunding the unused portion of your fees. Any such refunds are given on a case-by-case basis and solely at Localgofer’s discretion, unless required by law.
This refund policy does not affect any rights you may have under New Zealand consumer protection laws. However, please note that if you are using our Service for business purposes (which is typically the case for Localgofer listings), then the Consumer Guarantees Act 1993 may not apply (see Section 10 below). 6.3 Changes to Plans and Pricing
Localgofer reserves the right to change the fees for any of our plans or to introduce new charges, with reasonable notice to you. Price changes will not affect your current subscription term but would apply upon renewal. We will notify you (for example, by email or via the site) if there will be a price increase or changes to your plan features. If you do not agree with a price or plan change, you will need to cancel your subscription before the new charges apply (see Cancellation in Section 7). Continuing to use the Service or keeping your listing active after a price change constitutes acceptance of the new prices.
7. Cancellation and Termination of Service
7.1 User Cancellation
You have the right to cancel your subscription or delete your business listing at any time. This can usually be done through your account dashboard by choosing to cancel your plan or remove the listing, or by contacting Localgofer support at [email protected] with your request. If you cancel a paid subscription, your listing will remain active for the remainder of the period you have paid for, and then it will not renew. Alternatively, if you wish to remove your listing immediately, we can take it down upon cancellation; however, any fees paid for the current term will not be refunded except as provided in Section 6.2.
When a listing is deleted or a subscription is cancelled, we will remove the business profile from public view on our directories typically within a few business days. Please note that due to caching or search engine indexing, some information may remain visible in search results for a time even after removal from our sites; Localgofer does not control third-party search engine caches.
7.2 Termination or Suspension by Localgofer
Localgofer may suspend or terminate your account or any listing, with or without notice, if we reasonably believe: (a) you have violated these Terms or any applicable law; (b) you are engaging in behavior that is harmful to the platform or other users; or (c) it’s necessary for security, legal compliance, or to protect our rights or those of others. For example, if you post prohibited content or engage in fraud, we may deactivate or remove your listings immediately. In less severe cases or where appropriate, we might provide a warning and an opportunity to correct the issue first.
If your account or listing is terminated due to your breach of these Terms or misconduct, you will not be entitled to any refund of fees you have paid. Additionally, Localgofer may refuse to allow you to create new listings or accounts in the future. We also reserve the right to remove or modify any content that violates our guidelines (per Section 5.3) or to deactivate listings that have become outdated or inaccurate (for example, if we learn a business has closed down).
7.3 Effect of Termination
Upon termination of your account or listing, these Terms will no longer directly apply to you, except that any provisions that by their nature should survive (such as limitations of liability, indemnity, and any licenses you granted to content already in use) will survive. If your account is terminated, you must cease all use of the Service and not attempt to access it. We are not obligated to maintain or provide you with any content you have submitted (for example, if a listing is removed, we typically will not retain the listing details accessible to you), except as required by law. However, we may retain certain information internally for record-keeping, analytics, or legal purposes as described in our Privacy Policy.
8. Disclaimer of Warranties
The Localgofer Service is provided “as is” and “as available” to the fullest extent permitted by law. While we strive to provide a high-quality service, we do not guarantee that the Service will meet your requirements or expectations, nor that it will be uninterrupted, error-free, or secure at all times.
In particular, Localgofer makes no representation or warranty that: (a) the directories will always be available or accessible (there may be occasional downtime for maintenance or factors outside our control); (b) any defects or errors will be corrected immediately; (c) the information on the directories (including business listings) is complete, accurate, or up-to-date (the content is largely user-provided, and while we try to enforce accuracy, we cannot warrant it); or (d) using the Service will result in any specific outcome for your business (for example, we do not promise any increase in website traffic or customer inquiries through being listed).
To the extent that New Zealand law allows, we exclude all implied warranties or conditions that are not expressly stated in these Terms. This includes any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, or any arising from a course of dealing or usage of trade. If under law we cannot fully exclude certain warranties (for instance, certain consumer rights may apply if you are deemed a consumer), then we limit those warranties to the minimum extent permitted.
If you are using Localgofer for business purposes, you agree that the guarantees and remedies provided under the New Zealand Consumer Guarantees Act 1993 do not apply to this Service, as that Act does not cover goods or services supplied for business use. (In other words, you confirm that you are using this Service for the purposes of a business and not as a personal consumer, which means certain consumer protections may not apply.) In any case, nothing in these Terms is intended to exclude any mandatory guarantee or right you have under law; and where a mandatory guarantee is applicable, our liability is limited to the remedies provided under that law.
9. Limitation of Liability
To the maximum extent permitted by law, Localgofer and its directors, officers, employees, and agents will not be liable to you for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of (or inability to use) the Service. This includes, without limitation, any damages for lost profits or revenue, lost business opportunities, loss of data, business interruption, or any other commercial or economic loss, even if we have been advised of the possibility of such damages. We are also not responsible for any cost of procuring substitute services or any technology failures outside our control.
In no event shall Localgofer’s aggregate liability for all claims relating to your use of the Service exceed the total amount of fees that you have paid to us (if any) in the six (6) months immediately preceding the event giving rise to the claim. If you have not paid any fees (for example, if at some point we offer free listings), our total liability will be zero for such free use. These limitations apply to any theory of liability, whether based on warranty, contract, statute, tort (including negligence), or otherwise.
No Liability for User Content or Third Parties: Because business listings and content on Localgofer are provided by users, we are not liable for any statements, representations, or content provided by third-party users in their listings. Localgofer does not assume responsibility for the conduct of users or the quality of the businesses listed. Any dealings you have with customers or other third parties arising from your listing (for instance, communications or transactions initiated through a Localgofer directory) are solely between you and that third party, unless and except as explicitly stated otherwise.
No Liability for Events Beyond Our Control: Localgofer will not be liable for any failure or delay in performing our obligations due to causes outside our reasonable control. This includes, for example, natural disasters, acts of God, acts of government, war, civil unrest, strikes or labour disputes, power or telecommunication outages, internet or hosting provider failures, or any other events of force majeure. If such events occur, we will make reasonable efforts to resume the Service, but we will not be in breach of these Terms because of the delays or failures resulting from such events.
To the extent that any such law applies to this agreement, some of the exclusions or limitations above may not apply to you, and in that case, Localgofer’s liability will be limited to the fullest extent permitted by applicable law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Localgofer, its parent company, affiliates, and their respective officers, directors, employees, and agents (collectively, the “Indemnified Parties”) from and against any and all claims, demands, lawsuits, proceedings, liabilities, damages, or costs (including reasonable attorney’s fees and court costs) that arise out of or relate to: (a) the content you submit, post, or transmit via Localgofer (including your business listing and any user-provided information); (b) your use of the Service or activities in connection with the Service; (c) your breach of any provision of these Terms or violation of any applicable law or regulation; or (d) your infringement of any rights of another person or entity (for example, intellectual property rights or privacy rights).
This means that if a third party (such as another business, a customer, or any other party) makes a claim against Localgofer or the Indemnified Parties due to something you did – for instance, they claim that content you posted is defamatory, violates their copyright, or that you engaged in unlawful conduct via our Service – then you will cover any loss or expense we suffer, including legal fees, to the extent that claim is due to your actions or content. We will notify you promptly of any such claim and may require that you assist in the defence. We reserve the right to handle our legal defence however we see fit, even if you are indemnifying us, and you agree to cooperate with us.
11. Communications and Electronic Messages
By creating an account or listing on Localgofer, you consent to receive communications from us electronically, such as emails. These communications may include account-related messages (e.g. payment receipts, notifications of inquiries via your contact form, system updates) as well as promotional emails about new features, updates, or offers from Localgofer or its affiliated entities. We will handle your personal information (including your email address) in accordance with our Privacy Policy (see separate document, “Localgofer Privacy Policy”).
Localgofer is committed to complying with New Zealand’s Unsolicited Electronic Messages Act 2007 (“UEMA”) regarding commercial electronic messages. This means we will only send you marketing emails or texts if we have your consent or if you are an existing customer in a context that implies consent, and we will include proper identification and an easy way to opt-out of future messages. All marketing emails from Localgofer (or our network sites) will clearly identify us as the sender and will contain our contact information and an “unsubscribe” link or instructions. You can opt out of marketing communications at any time by clicking the unsubscribe link in the email or contacting us. Even if you opt out of marketing messages, we may still send you important transactional or service communications (such as renewal notices, security alerts, or messages about your account or listing).
You agree that any notices, agreements, disclosures or other communications we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing.
12. Privacy and Data Protection
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains how we collect, use, and protect your personal information when you use Localgofer. By using our Service, you consent to the collection and use of information as outlined in the Privacy Policy. We comply with New Zealand’s Privacy Act 2020 regarding personal information handling, and we adhere to its principles for collecting, using, and disclosing personal data. We do not share your email or personal details with third parties for their own marketing purposes, and we take steps to secure your data. Please review the Privacy Policy for more details.
If you are listing personal contact details on our directories, be aware that this information may become public (accessible to users of the sites) if you choose to display it. You are responsible for ensuring that displaying such information complies with privacy laws (if you post someone else’s personal contact info, you must have their consent). We offer the option to use a contact form to facilitate communication without directly exposing your email address.
13. Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of New Zealand. You agree that any dispute or claim arising out of or relating to these Terms or your use of the Service shall be subject to the non-exclusive jurisdiction of the courts of New Zealand. This means that if you are a New Zealand resident or business, any legal action will likely be brought in New Zealand. If you reside outside of New Zealand, you acknowledge that New Zealand courts may still have jurisdiction and that you submit to such jurisdiction to resolve any disputes. Nothing in this clause limits our right to seek injunctive relief in any appropriate jurisdiction in case of urgent need (for example, to protect our intellectual property).
14. Changes to Terms
Localgofer may modify or update these Terms from time to time. If we make material changes, we will provide reasonable notice to you, such as by posting the updated Terms on our website and updating the “last modified” date, or by sending a notification to the email associated with your account. It is your responsibility to review these Terms periodically. Your continued use of the Service after any changes to the Terms have been posted or communicated will constitute your acceptance of those changes. If you do not agree with a change, you should stop using the Service and (if applicable) cancel your account before the updated Terms apply to you.
15. Miscellaneous
- Entire Agreement: These Terms (together with any additional agreements you may enter into with Localgofer, such as a Privacy Policy or specific plan terms) constitute the entire agreement between you and Localgofer regarding the Service, and supersede any prior understandings or agreements on the subject.
- No Waiver: If we fail to enforce any part of these Terms, it will not be deemed a waiver of our right to do so later. Any waiver of compliance with these Terms must be in writing and signed by an authorised representative of Localgofer.
- Severability: If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remainder of the Terms will remain in full force and effect.
- Assignment: You may not assign or transfer your rights or obligations under these Terms to anyone else without our prior written consent. We may assign our rights and obligations to an affiliate or in connection with a merger, acquisition, or sale of assets, or by operation of law.
- No Professional Advice: Information on the Localgofer directories (including any articles or guides we may provide) is for general informational purposes only and does not constitute professional advice (legal, financial, etc.). You should consult appropriate professionals for advice specific to your situation.
- Relationship: Using Localgofer does not create any agency, partnership, joint venture, or employment relationship between you and Localgofer. You act on your own behalf in creating and managing listings.

Localgofer Privacy Policy

1. Introduction
Localgofer (“we”, “us”, or “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you use Localgofer’s network of local directory websites and related services (the “Service”). It also outlines your rights and choices regarding your personal data. We adhere to the New Zealand Privacy Act 2020 and its Information Privacy Principles in handling personal information, as well as other applicable privacy and data protection laws. By using our Service or providing us with information, you consent to the practices described in this Policy.
This Privacy Policy applies to information collected through our websites (including all regional or city directory sites operated by Localgofer) as well as any offline interactions with us related to the Service. Please read this Policy carefully to understand how we deal with your information. If you do not agree with any part of this Policy, please do not use the Service.
2. Information We Collect
We collect several types of information from or about our users and business listers, including:
- Account and Contact Information: When you register for a Localgofer account or list a business, we collect personal information such as your name, email address, and password. If you provide a phone number or other contact details for your account, we will collect those as well. This information is used to create and secure your account and to communicate with you.
- Business Listing Information: When you create a business listing, we collect the details you provide about the business. This can include the business name, industry/category, physical address, phone number, email address, website URL, hours of operation, social media links, and any descriptive information about the business. You may also upload content like logos or photos for the listing. Providing phone, email, or address is optional – you can choose whether to display those on your public profile. If you choose to display them, they will be visible to visitors of our directories.
- Profile Content: Any text, images, or other media you submit as part of your business profile or user profile are collected and stored by us. For example, the business description, list of services, and any keywords or tags you add to your listing are part of the information we collect. We also store any updates or changes you make to your listing over time.
- Communication Data:
- Messages via Contact Forms: If your listing has the contact form enabled, when a visitor sends a message to you through that form, we collect the information in that message. Typically, this includes the sender’s name, contact info (like email or phone if provided), and the content of the message. We forward these messages to the email address you have on file or make them available in your account dashboard. Please be aware that Localgofer administrators can access and review these communications, for example, to monitor for spam, abuse, or troubleshooting purposes. We treat these messages as private between the sender, you (the recipient business), and Localgofer, and we will not disclose their content to unrelated third parties except as required by law or for service monitoring.
- Call/Email Interaction Data: If our directories provide features like “Call” buttons or “Email” links (for instance, clicking on an email address), we may record the fact that a user interacted with your contact information. For example, we might log that your phone number was revealed or that a user clicked to show your email address. In some cases, we might use a call forwarding or tracking number for analytics – if so, we would log call duration or that a connection was made. We do not record the audio of phone calls – only the fact that a call was initiated and basic metadata, and we do not capture the content of any emails beyond the contact form case described above. This interaction data is used for analytics (to gauge activity on listings) and to potentially show you how many leads your listing is generating.
- Login and Usage Data: When you log into your account or use our sites, our servers automatically collect information such as your IP address, the type of browser and device you use, the pages or features you access, the dates/times of access, and other standard web log information. We record login history (e.g., when you last logged in, and from what IP). IP addresses may be considered personal information, and we collect them as part of our security and audit logs. This data helps us troubleshoot issues, secure the Service (for example, detecting suspicious login attempts), and understand usage patterns.
- Cookies and Similar Technologies: We use cookies (small text files stored on your device) and similar tracking technologies to provide and improve our Service. For example, cookies help keep you logged in as you navigate the site, remember your preferences, and track aggregate usage of the directories. We may use first-party and third-party cookies for analytics (such as Google Analytics) to collect information about how users find and use our websites. These analytics cookies collect data like pages visited, time on site, referring websites, and other usage metrics. We do not use cookies to serve third-party advertisements, and we do not track you across sites we do not operate. - Payment Information: If you purchase a paid plan, our third-party payment processor (e.g., credit card processor) will collect your payment card details and billing information. Localgofer itself does not store your full credit card number or CVV on our servers. We may store limited information about your transaction, such as an invoice record, the last four digits of your card, the cardholder’s name, and billing address, for record-keeping and to handle billing inquiries. All payment transactions are processed using secure encryption and are subject to the payment processor’s privacy policy.
- Optional Surveys or Feedback: We may occasionally request feedback, conduct surveys, or run promotions. Your participation in these is voluntary. If you choose to respond, we will collect whatever information you provide (for example, survey responses or contest entry information). This helps us improve our services.
We aim to only collect personal information that is reasonably necessary for the purposes described in this Policy. If you choose not to provide certain information (like contact info or certain business details), you may still use the Service, but your ability to utilise some features (for example, receiving inquiries if no contact method is provided) may be limited.
3. How We Use Your Information
Localgofer uses the collected information for various purposes related to operating and improving our directory services, as well as communicating with you. The primary uses of personal information are:
- Providing the Service: We use your information to create and publish your business listing across our directory network. For example, the details you provide (business name, address, description, etc.) are displayed on our websites so that users can find and learn about your business. We also use your account information to allow you to log in, manage your profile, and use features of the site. Essentially, without using your submitted information, we couldn’t operate the directory service or give you the functionality you expect.
- Communicating with You: We use contact information (like your email and possibly phone number) to send you service-related communications. This includes administrative messages such as confirmations of your listing submission, receipts for payments, alerts when someone sends you a message via your listing’s contact form, or notices of updates to our Terms or Privacy Policy. We may also send customer service communications to respond to your inquiries, provide support, or resolve issues you report.
- Marketing and Updates: With your consent or as otherwise permitted by law, we may use your email address to send you newsletters, marketing emails, or promotional offers related to Localgofer or our network of directory sites. For example, we might send updates about new features, new directory launches in other regions, special promotions, or tips for getting more out of your listing. We will ensure that any commercial electronic messages we send comply with New Zealand’s anti-spam laws – emails will include our identification and contact details and an easy unsubscribe option. You can opt out of marketing emails at any time (see Section 6 on Your Choices). We do not share your personal contact information with third-party companies for their own marketing use (no selling or renting of your email address). Any marketing communications will come from Localgofer or its affiliated entities operating the directory network, and you can opt out as you wish.
- Analytics and Improvements: We use data (including aggregated listing data, usage logs, and cookie data) to understand how our Service is used and to improve it. For example, we analyse interaction data (like how often contact buttons are clicked, or which pages are most visited) to gauge the effectiveness of our directories and features. We might track the overall number of visitors to certain categories or regions to decide where to focus improvements. This helps us troubleshoot technical issues, optimise user experience, and develop new features or services. We may also use your feedback or survey responses to make improvements.
- Security and Abuse Prevention: Information such as IP logs, login history, and message content may be used to detect and prevent fraudulent or malicious activity. For instance, we may analyse logs to spot multiple failed login attempts (which could indicate a hacking attempt) or use automated systems to scan messages sent via contact forms for spam or prohibited content. If we identify potential abuse (like a user sending harassing messages or a listing containing illegal content), we may use the relevant information to investigate and take appropriate action (e.g., warning or banning a user, removing content, or reporting to authorities if required).
- Compliance with Legal Obligations: We may process and retain personal information as needed to comply with legal and regulatory requirements. For example, we might keep certain financial transaction records for tax or accounting purposes, or we may disclose information in response to a lawful request by public authorities (such as for law enforcement or regulatory inquiries), as described in Section 4 below. We also use personal data to enforce our Terms and Conditions and to resolve disputes, which may involve legal processes.
- Aggregated and De-Identified Data: We may aggregate or anonymise personal information so that it no longer identifies an individual (for example, compiling statistics on the number of listings in a region, or average views per listing, without any personal identifiers). We use this aggregated data for research, analysis, and marketing (such as publishing trends or insights about local businesses). Aggregated data does not personally identify you, so it may be used more freely, but we still ensure that such use does not compromise your privacy.
We will only use your personal information for the purposes we collected it for, unless we reasonably consider that we need to use it for a related compatible purpose. If we need to use your data for an unrelated purpose, we will notify you and obtain consent where required or ensure we have a lawful basis as per the Privacy Act.
4. Disclosure of Your Information
Localgofer respects the confidentiality of your personal information. We do not sell your personal data to third parties. However, in the normal course of providing our services, there are situations where we may share or disclose your information to others, as outlined below:
- Affiliated Entities: Localgofer operates through a network of local directory websites (for example, region-specific directory sites). These sites might be managed by Localgofer or its affiliated organisations within the same corporate group. We may share your information within our family of related companies or entities that are directly involved in running the Service. This is primarily so that your business listing and account can be recognised across all our directory websites, and so our support and technical teams can manage the service. All such entities will treat your information in accordance with this Privacy Policy.
- Service Providers (Third-Party Processors): We use trusted third-party companies to help us operate and improve Localgofer. Examples include website hosting providers, data centres or cloud storage providers, email delivery services, analytics providers (like Google Analytics), and payment processors. These service providers may process personal information on our behalf for the purposes described in this Policy – for instance, to host data (including your profile information and images), to send out emails (your email address and name might be processed by an email service to deliver messages), or to process payments (billing info by a payment gateway). We only share the information that is necessary for these providers to perform their functions, and we contractually require them to protect your data and use it only for the specific services they are providing to us. They are not permitted to use your info for their own purposes.
- Business Profile Visibility: Keep in mind that if you provide personal information as part of a business listing intended to be public, that information will be visible to anyone who accesses our directories. For instance, if you include a personal phone number or an email address in the business listing details and choose to display it, that contact detail becomes public. Similarly, if you post a profile under your own name as the business owner, that name is public. We cannot control how other visitors use or disclose publicly available information that you choose to place in your listing. (However, we do provide a contact form as an alternative to display email addresses publicly, to help mitigate spam to your email.) Please only include information in your public profile that you are comfortable sharing with the public.
- Legal Requirements and Safety: We may disclose personal information if required to do so by law or legal process. This can include responding to subpoenas, court orders, or other legal requests, or to meet obligations under legislation. We will also disclose data if we believe in good faith that such disclosure is necessary to (i) comply with applicable laws or regulations, (ii) investigate, prevent, or take action regarding suspected or actual illegal activities or to assist law enforcement (for example, addressing fraud, security, or technical issues), (iii) enforce our Terms and Conditions or other agreements, or (iv) protect the rights, property, or safety of Localgofer, our users, or the public. For instance, if someone posts content that is part of a legal dispute (like trademark infringement), we might share their contact info with the complaining party as required by law, or if a user is sending threatening messages through our system, we might provide data to the police.
- Business Transfers: In the event that Localgofer or its related entities go through a business transition such as a merger, acquisition by another company, or sale of all or part of its assets, user information (including personal data) may be among the assets transferred. We would ensure that any successor entity either continues to handle your personal information in accordance with this Policy or provides notice of any changes. Similarly, if we go through restructuring or bankruptcy proceedings, your information may be transferred as part of that process, subject to the same protections.
- Third-Party Listings or Referrals: If the Service allows you to share a listing with someone (for example, emailing a link to a friend) or refer someone to our service, we might share certain information in that context. However, those features will be clearly indicated (and usually involve you providing someone else’s contact info, which we then use only to send the one-time referral message).
We will endeavour to disclose only as much information as is necessary in each of these scenarios. When disclosing under legal requests, we will carefully review that the request meets legal standards and only then comply.
Importantly, we do not disclose your personal information to third parties for them to market their own products or services to you. Your data is used to support your use of Localgofer and as outlined above, not for others’ independent commercial use.
5. Cookies and Tracking Technologies
Cookies: Localgofer uses cookies and similar tracking technologies to provide and enhance our Service. Cookies are small data files stored on your browser or device that help websites remember information about your visit. We use cookies for several purposes:

Much of your basic account and listing information can be accessed and edited simply by logging into your account and viewing your profile or business listing dashboard. For example, you can at any time update your business listing details, change your account email, or edit content you have posted. We will respond to access requests within the timeframe required by law (in New Zealand, we aim to respond no later than 20 working days). Before providing data, we may need to verify your identity for security. Where legally entitled, you may also request that we correct or update any inaccurate, incomplete, or outdated personal information we hold. If we refuse a correction request (for instance, if we believe the information is accurate or we are legally entitled to keep it as is), we will provide an explanation and your options under the law.
- Deletion of Information: You have the option to delete your business listing or account, as described in our Terms and Conditions. When you delete a listing via your account, the public content is taken down from our directories. You may also contact us to request the deletion of personal information we hold about you. We will take reasonable steps to erase or anonymise your personal data upon request, provided that we do not have a legal obligation or a legitimate business reason to retain it. Note that certain data might not be fully deleted from all systems immediately (for example, data in backups might be overwritten in the normal backup cycle, and server logs might be retained for a period). Also, if you have engaged in any transactions (like paid subscriptions), we may retain transactional records for auditing. If you delete your account, residual information (like support emails you sent, or financial records) may remain in our archives, but are disassociated from your profile where possible.
- Opt-Out of Marketing: If you prefer not to receive marketing or promotional communications from us, you have the right to opt out. You can do so by clicking the “unsubscribe” link in any marketing email we send. You can also adjust your email preferences in your account settings (if such an option is provided) or by contacting us at [email protected] and requesting to be removed from marketing lists. Please note that even if you opt out of marketing messages, we will still send you important transactional or service-related communications (e.g., password resets, billing notices, critical alerts about the Service) as those are not promotional in nature. Localgofer takes reasonable and appropriate measures to protect the security of your personal information. - Encryption: We use HTTPS (TLS/SSL) encryption for data transmission on sensitive pages (such as when you log in or when you enter payment details) to prevent eavesdropping. Our databases or storage of personal data are protected by encryption or access controls where appropriate.

8. International Data Transfers
Localgofer is based in New Zealand. However, the personal information we collect may be stored and processed in data centres or with service providers outside of New Zealand. For example, we might use cloud hosting or email services that operate in other countries. Whenever your personal information is transferred to or stored in another country, we will ensure that adequate protections are in place as required by New Zealand’s Privacy Act.
The New Zealand Privacy Act 2020 includes Principle 12, which sets rules for disclosing personal information to foreign entities. In accordance with those requirements, Localgofer will only transfer personal data overseas if we reasonably believe that the recipient is subject to privacy safeguards comparable to New Zealand’s, or if we have otherwise taken steps to ensure your information will be protected (such as by contract). In practical terms, this means:

9. Retention of Data

- Account and Listing Data: If you have an active account and listing, we retain your personal and business information for as long as your account exists or as long as needed to provide you the Service. Business listing information is kept for the duration of the listing being published. If you decide to delete your listing or close your account, we will initiate the process of removing your data. Publicly, the listing will be taken down (usually within a few days). Internally, we may mark your account as deactivated. Some data (like your account email or name) might still exist in our archives or backups for a period, but we will restrict access to it and eventually delete or anonymise it in accordance with our data retention schedules.
- Communication Records: If you have communicated with us (for example, contacted customer support, or sent emails to [email protected]), we may retain those communications as long as necessary to address your issue and for our training or documentation purposes. Contact form messages that were sent to you may be stored in your account and in our database; if you delete your account, those messages may be deleted or anonymised as part of that process, though some record that a communication occurred may remain for system logs.
- Transactional and Legal Records: We retain billing records, invoices, and payment history as required for financial reporting and compliance (often for a minimum of 7 years due to tax regulations in New Zealand). If you have given consent for marketing, we will keep that consent record until you withdraw it, and maintain records of your opt-outs as required by anti-spam laws (to ensure we respect your choices going forward). We also keep logs and security records as needed – for instance, server logs may be kept for a certain number of months and then automatically purged, unless they are needed longer for investigation of abuse or security incidents.
- Backup Policy: Our system likely performs routine backups for reliability. Backup data is retained for a limited time and then overwritten with newer backups. When you delete data, it will be removed from the live database, but could persist in backups for a while until those backups cycle out. We treat information in backups with the same security as production data. If we restore a backup for any reason, and it includes data that you had previously deleted, we will re-delete that data as appropriate after restoration.
When we no longer have a legitimate need to retain your personal information, we will securely dispose of it. In some cases, rather than deletion, we may anonymise your data so it can no longer be associated with you. For example, we might convert an account record into an aggregate statistic for analytical purposes, without any personal identifiers.

Localgofer’s services and directories are not directed to children under the age of 18. Our Service is intended for use by business owners and professionals in a commercial context. We do not knowingly collect personal information from children. If you are under the relevant age, please do not use our Service or provide any personal information to us.
